Welcome to Hire with Oyster. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our platform.
1. Acceptance of Terms
By registering for, accessing, or using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, along with our Privacy Policy, as per the Information Technology Act, 2000 and other applicable Indian laws.
2. Services Provided
Hire with Oyster provides a platform that enables businesses to hire, pay, and manage remote employees and contractors globally while ensuring compliance with the applicable laws and regulations, including the Indian Contract Act, 1872 and the Companies Act, 2013.
3. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract under the Indian Contract Act, 1872 to use our services. By using our platform, you represent and warrant that you meet these requirements.
4. User Responsibilities

Provide accurate and up-to-date information.

Maintain the confidentiality of account credentials.

Comply with all applicable laws, including but not limited to, the Information Technology Act, 2000 and the Payment and Settlement Systems Act, 2007.

Refrain from using the service for any illegal or unauthorized purpose.
5. Employer and Employee Relationship
Hire with Oyster acts as an Employer of Record (EOR) where applicable but does not assume liability for direct employment responsibilities beyond legal compliance facilitation under the applicable Indian labor laws, including the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 and the Payment of Wages Act, 1936.
6. Payment and Fees

Employers agree to pay applicable fees for hiring and payroll services.

Fees are subject to change, and any modifications will be communicated in advance.

Late payments may incur additional charges or suspension of services, as per the Indian Contract Act, 1872.
7. Intellectual Property
All content, trademarks, and materials provided through the platform remain the exclusive property of Hire with Oyster and may not be copied, modified, or distributed without prior written consent, as per the Copyright Act, 1957 and the Trade Marks Act, 1999.
8. Limitation of Liability
To the maximum extent permitted by Indian law, Hire with Oyster shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, in accordance with the Consumer Protection Act, 2019.
9. Termination
We reserve the right to terminate or suspend access to our services at our sole discretion if users violate these terms or engage in fraudulent or harmful activities, as per the applicable provisions of the Information Technology Act, 2000.
10. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in [Insert Jurisdiction], India.
